Can I use Alberta Online Divorce for my divorce?
Generally, if either spouse has lived in the province where you intend to file, you can use Alberta Online Divorce.
Alberta Online Divorce cannot resolve contested cases. If you cannot come to an agreement you should first try mediation. If that does not work and you need to have a court hearing, you should contact an attorney.
How does payment work?
Users will be charged the $159 document preparation fee to receive their completed divorce forms. After that, subscribers will be sent email reminders before each monthly charge.
What if I want information, but I'm not sure about getting a divorce at this time?
The information and law provided with each question, as well as the forms provided at the end of the process will provide a great deal of information about the law and process relating to getting a divorce.
If you choose not to file the documents, you will not get a divorce. You can use the information and the forms for informational purposes if you wish.
What software programs will I need?
In order to view and print the forms, you will need Adobe Acrobat software which creates PDF files.
Your computer probably has this software, but if not, Alberta Online Divorce provides a link to download the software.
The software is free and the download is quick.
Can I change my answers later?
Yes. If you change your mind, make a mistake or if your spouse has changes, you can return to your account for a full 30 days to make changes.
Once you finish the last question and confirm that you are ready to have your documents created, changes to the completed documents may cause an additional fee to be incurred.
How do I change my answers?
You can use the back button on your browser to return to questions you just answered.
You can click on the status bar to view all of the questions you have answered, then click on the question and provide a different answer.
Will my documents be reviewed by a lawyer?
No. Alberta Online Divorce operates without attorneys. No lawyer will review the documents.
Alberta Online Divorce employees cannot offer legal advice. However, the explanations provided with each question are simple and clear and the law is provided for some questions if you wish to review it.
Is technical support available?
Yes. If you have any difficulty with the use of the site, other than legal questions, support is available quickly via email or telephone at no additional charge.
What if my computer crashes or I have to leave in the middle of the process?
You may return to your account using your email address and password at any time. You will be returned to the point where you left off, at any time, even weeks later.
Does my spouse need to sign the documents?
Yes. Alberta Online Divorce is for uncontested divorces. This means that you will need to have an agreement.
You do not need to have an agreement immediately, but you will need to agree before submitting your completed answers after answering the last question online.
At some point, when you reach an agreement, your spouse will need to sign the documents.
Does my spouse have to use the site with me?
No. Alberta Online Divorce is designed to be used by one spouse, who will then give the documents to the other spouse for their review.
You can return to Alberta Online Divorce to make changes as necessary, after discussing it with your spouse. You will need to come to an agreement before confirming completion at the end of the question process.
Of course, there is nothing restricting both spouses from sitting at the computer together and answering the questions. If you wish, you can also give your spouse access to your Alberta Online Divorce account at any time so they can use it on their own.
What if I have legal questions before I start using Alberta Online Divorce?
Alberta Online Divorce employees cannot answer legal questions. However, each of the questions asked during the process has a simple explanation and some have laws to review.
Most legal questions are addressed through the process of answering the questions and reading explanations and law as necessary.
